In FL.If an auto insurance company if only paying for 70% of my total car value, do they have the right?
2real4sum asked:
to legally place my car under total status.
Here's the story. The adjuster advised me that my car's value is at $10,812. They are responsible for only 100% of the damages to the rear of my car and 30% of the front and for 70% of the value of the car. If they are offering me $7,569(which is 70% of the total value of my car, do they still have the right to place my car in a 'totaled' status since they are not paying $8,109(which is 75% of the value of my car)?
I want to repair my car being that I owe $16,000 on it and I don't have GAP insurance. My car is 100% repairable. The repair shop is telling me that the total repair cost are $7500 but the insurance company is saying that they are not paying to have the vehicle repaired but will cut me a check for the $7569 and I will still keep the my car and I can do whatever I want to do with the check, get the car repair and etc..I don't agree with placing my car in total status because I will have to get a salvage license on the title
This is the insurance company of the person who rear ended my car. They say that they are only paying for 30% because I did bump the car in front of me which caused very little damage to the front and to the rear of the car in front of me…and folks when I say little I mean a little…… like a scratch of paint about 5 inches long, before their client hit me while going at least 55mph pushing me even further into the back of the car in front of me…but that is another story…….

I don't want to accept that offer if they are going to place my car into a totaled status…..
who can or what do I do?
All I want is my car repaired. That is it…….I am not even worried about a rental car right now, i just want my car repaired.
to answerer Oklaton….how can I sell the car if it has $7500 of repair damage and I don't hold the title to it and I owe the finance company $16k?
I have never been in a car accident before and have never dealt with insurance companies before so I am very lost when it comes to this.

If you are keeping the car then you don't have to get a salvage title.

Regardless of what percentage they actually pay on your car, it the total cost to repair it is more than the actual cash value of the vehicle, and it's considered totaled by the insurance company, you WILL be issued a salvage title if you choose to keep the car. They really don't need you to agree with their decision, or particularly care if you do or don't agree.
If you don't want a car with a salvage title, take the check they are giving you, plus whatever monies you get from selling your car and apply it to something you are more pleased with that won't have a salvage title.

Florida law is very simple..
If the repair cost of your car (and this doesnt mean what joe bob your local mechanic/neighbor will do it for.. it means what a qualified mechanic who will take care of every little bit of damage will do it for) is over 80% of the cars value.. it MUST be totalled. This isnt the insurance companies choice.. its the law.
Therefore- if that TOTAL DAMAGE ESTIMATE was over 8000.00 approximately (this is for 100% of the damage cost- not the 70% they are covering).. they car will get a salvage title… whether you like it or not.. there is nothing they can do. Its a safety issue.
What im confused about is the fact you are going through their insurance… you are required to have collision on your vehicle since its financed.. why arent you going through your carrier to get 100% of the damages covered (or atleast 100% of the value?) This just doesnt make sense.
Whether a car is repairable or totalled is NOT negiotible. clearly your car is over the threshold.. theyve accepted liability @ 70%.. and you must take their offer or leave it. again- its not their choice.. its state law.
